A Modification action is designed to change the terms of an existing court order based on a material change in circumstances that has taken place after the initial order was entered. In Family Law cases, these modifications frequently involve Child Support, Visitation and/or Custody provisions of existing Divorce Orders or Paternity and Legitimacy Orders. Modification actions often become necessary when either parent and/or the child relocate. Sometimes the relocation of the custodial parent brings about a change in physical custody and a reversal of which parent is obligated to pay child support.
